Assisted Reproduction Techniques Regulation Bill, 2020

In order to protect the reproductive rights of women, The Union Cabinet presided over by the reverend Prime Minister, Mr Narendra Damodardas Modi, has given its nod to a remarkable Bill for the Women welfare in the Country – the Assisted Reproductive Technology Regulation Bill 2020. 

 The code of conduct to be observed by staff working at clinics will be formulated by the National Board. The code of conduct will set the minimum standards of laboratory and diagnostic equipment, expert manpower and physical infrastructure, to be utilized by banks and clinics. 

 Once the Parliament enacts the Bill, the date of the initiation of the Act will be notified by the Central Government. Eventually, the constitution of the National Board will take place.

The State Boards and State Authorities will be constituted by the States and Union Territories in a period of three months of issuance of the notification by the Central Government.

The onus of adhering to the plans and policies formulated by the National Board for the state Banks and clinics lies with the State Board.

The Assisted Reproduction Technique Bill also provides maintaining a Central database and assisting the National Board in its functioning by the National Registry and Registration Authority. The Bill also proffers an ironclad punishment for those who practise a selection of a particular sex in babies, infants and foetus, sale of fertilized human eggs or gametes of both the sexes and those operating rackets/organizations/agencies for such illicit and unlawful practices.

Types:

In-Vitro Fertilisation (IVF): 

In Vitro Fertilisation or, IVF as it is commonly known, is the technique wherein the male and female gametes are allowed to fuse in the laboratory settings, and then the embryo(s) is(are) placed in the uterus of the female after which the process of its development takes place naturally in the female’s body. Assisted Reproductive Technology IVF involves the transfer of embryo from the lab to the female’s body.

IntraCytoplasmic Sperm Injection (ICSI): 

This technique involves the insertion of sperm directly into the female egg in the laboratory settings in the petri dish thus fertilizing it, and ultimately, it is transferred into the female body after which, it develops naturally.

Surrogacy: This is of two types:

Traditional surrogacy and Gestational Carrier. Here, a female outside of the marriage carries the pregnancy to the full term for the couple. This can be done using her own egg or that of the intended mother. The procedure is performed using IVF wherein the gametes fuse in the laboratory in a petri dish and then transferred to the female’s body, also known as the surrogate mother.

Gamete IntraFallopian Transfer (GIFT): 

Gamete Intra Fallopian Transfer is also known as GIFT, is a mutated version of IVF treatment. Wherein, the gametes are put in the fallopian tube of the female, thus leaning more towards the natural method of fertilization. Like IVF, this procedure involves the mixing together of sperm and eggs before being inserted and, left for fertilization inside the fallopian tubes.

Artificial Insemination (AI): 

Artificial insemination is a technique wherein the semen is inserted directly into the fallopian tube or, the uterus of the female.

Donor Conception: 

Here, ovum, sperm or embryos or both eggs and sperm (double donation) from donors are used to help the couple with conception. This is used as a cure for infertility problems. It can also be used to aid family building for women without a male partner and lesbian couples.

Procedure

The procedure is more or less the same regardless of the method utilized by the couple. Ovum and sperm are extracted from the bodies in all of them, and eventually, either the embryo or the gametes are placed in the female body for the development.

Risk and Side effects

Vaginal and pelvic bleeding: 

Usually, the bleeding if occurs because of the procedure, settles by itself but, in very rare cases, the point of bleeding requires surgical binding. Bleeding can be caused due to accidental lacerations and/or accidental collides of the instruments.

Pelvic Infections: 

This may lead to permanent damage to the fallopian tubes and/ or an abscess in the pelvic area, and might require further surgery and hospitalization of the patients. Bruising:

Risks of full general anaesthesia include temporary paralysis, vomiting, allergic rashes, and it might prove fatal in the most extreme cases. However, full general analgesia is rarely used.
